Arthur's Place Terms and Conditions

INTRODUCTION

In these Terms & Conditions, references to “we” “our” or “us” will mean Arthur’s Place Community Interest Company and/or any partners engaged by us to provide the Arthur’s Place website or any Content. Any reference to “you” means the person accessing the Arthur’s Place website (whether registered or not).

We may make changes to these Terms & Conditions from time to time, so please check back here regularly. You can check when we last changed these Terms & Conditions by referring to the ‘LAST UPDATED’ date at the top of this page.

ACCESS TO THE WEBSITE

Access to the Arthur’s Place website, including to the members, the Content, the Arthur’s Place Social Facebook group, and activities (together the “Community Tools,”) is subject to these Terms & Conditions, which include by reference, our Privacy Policy and our  Facebook Group Guidelines. By accessing the Arthur’s Place website, you will be considered to have agreed to these Terms & Conditions. By participating in the Arthur’s Place Social Facebook group you will abide by the Facebook Terms and Conditions. (https://www.facebook.com/legal/terms).

We may restrict, suspend or cancel your access to the Arthur’s Place Social Facebook group at any time and where you breach these Terms & Conditions by:

a. Failing to comply with the law or our Guidelines;
b. Providing false or misleading information about yourself either in your registration or on the Arthur’s Place website;
c. Allowing another person to access the Community Tools through your registration;
d. Stealing or misusing information, data, text, software, music, sound, photographs, graphics, video, messages or other materials (“Content”) provided by us on the Arthur’s Place website, for instance by reproducing our Content without our permission;
e. Stealing or misusing another user’s Content, for instance by posting another user’s personal information or Content in another location without their permission;
f. Modifying, disrupting or interfering with the Arthur’s Place website and/or our systems by any means, including through the use of scripts, viruses, or worms or other computer code that is harmful; or
g. Submitting Content or in any way using the Arthur’s Place website to defame, abuse, harass, stalk, threaten or otherwise violate the rights of others (whether they are users of the Arthur’s Place website or otherwise), including their rights to privacy.

We have no obligation to monitor the Arthur’s Place website or your participation in the Community Tools. However, we may monitor the Arthur’s Place website from time to time and disclose any Content as necessary or appropriate to protect our self and other users of the Arthur’s Place website and to satisfy any law, regulation or other governmental request. We may refuse to post any Content that we consider unacceptable, undesirable, inappropriate or in violation of these Terms & Conditions.

We will comply with all data protection laws in force in the United Kingdom and will only collect and use your personal information in accordance with our Privacy Policy.

If your use of the Arthur’s Place website or Arthur’s Place Social Facebook group is considered by us to be a criminal offence under any laws applicable in the United Kingdom, then we may report any such use to the relevant authorities and disclose to them your Content and personal information. In such instance, your right to access the Arthur’s Place Social Facebook group will cease immediately and your Content may be permanently erased.

CONTENT PROVIDED BY US

Content provided by us on or through the Arthur’s Place website is for general informational purposes only and we do not guarantee that it is accurate, complete or current. Our Content is intended for people accessing it from within the United Kingdom and we do not guarantee that it complies with or is appropriate for use in other countries.

Our Content and any intellectual property rights in our Content are owned by us and our contributors and licensors. You may not supply, copy, reproduce or otherwise distribute our Content or any part of the Arthur’s Place website without our permission. However, we will not prevent the legitimate and reasonable use of our Content and/or the Arthur’s Place website for promotion of the Arthur’s Place website and arthritis awareness generally.

TAKING PART IN OUR FACEBOOK GROUP

In order to submit your own Content to Arthur’s Place Social, our Facebook group,  you will need to request membership and agree to be bound by these additional provisions:

• You will not submit Content to the Arthur’s Place Social Facebook group that you do not want to make public to the members of the group. If you become aware of any unauthorised access to your Facebook username and/or password, you will immediately contact us and take all reasonable action to prevent any further unauthorised access (by for instance changing your password immediately).

• You will show respect to all other users of the Arthur’s Place Social Facebook group and always comply with these Terms and Conditions (including the Guidelines and any other rules that we, or Facebook, may impose).

• You will not upload, post, distribute, link to, publish, reproduce, engage in or transmit Content that:

a. Is illegal, fraudulent, libelous, defamatory, obscene, pornographic, profane, threatening, abusive, hateful, harassing , offensive, inappropriate or objectionable information or communications of any kind, including conduct that would encourage or constitute an attack or “flaming” others;
b. Could expose us to criminal or civil liability under any applicable law;
c. Is false or misleading information about your identity or qualification;
d. Impersonates someone else, or that constitutes a breach of any individual’s privacy, including posting images about children or any third party without their consent (or a parent’s consent in the case of a minor);
e. Is an advertisement, investment opportunity, chain letter, pyramid scheme, or other unsolicited commercial communication;
f. Would constitute spamming or flooding;
g. Contains viruses, trojan horses, worms or other disruptive or harmful software or code; and
h. Is not legally yours where you have not got permission to use such Content.

• You will give us permission to use your Content for the purpose of providing the Arthur’s Place website and promoting the Arthur’s Place website and Arthur’s Place Social Facebook group on our Facebook® page, Twitter® account and in other marketing media. However, we will not sell, publish or share your Content in a way that could identify you without your explicit permission.

• You will give us permission to use or disclose your personal information in accordance with our Privacy Statement. You can view our Privacy Policy.

• You will indemnify us and any related third parties in full from and against all third party claims, liabilities, losses and expenses (including reasonable legal fees) incurred or suffered by such persons arising out of or related to your Content and/or any breach by you of any provision on these Terms & Conditions.

Where we reasonably suspect that some or all of your Content breaches these Terms & Conditions, we may delete any offensive content. In addition we may remove you from the Arthur’s Place Social Facebook group, and where applicable, report you to the appropriate authorities.

If you find any Content in the Arthur’s Place Social Facebook group objectionable or which you believe infringes your rights or applicable law then you should report it to us on Facebook using the “Report This Comment” functionality provided by Facebook.

YOUR PRIVACY AND PERSONAL INFORMATION

Personal information is any information that can be used to identify you. It includes your name, date of birth, email address, postal address, gender and telephone number, as well as information relating to your health. We collect personal information about you when you register for our Newsletter, send us an email, or communicate with us in any other way.

By continuing to access the Arthur’s Place Social Facebook group or registering for our Newsletter, you agree that we may use or disclose your personal information in accordance with our Privacy Policy and communicate with you electronically (including by email). You can view our Privacy Policy.

OTHER FEATURES AND PROMOTIONS

We will periodically issue updates for the Arthur’s Place website, which may include new or updated features, tools, utilities, improvements, third party applications, or general updates to improve and enhance the performance of the website. You agree that your use of the updates is entirely at your own risk and that such updates may contain errors or inaccuracies that could cause failures, corruption or loss of Content.

You may be invited to participate in promotions, such as competitions provided by us or our partners. These promotions may be subject to separate terms and conditions.

We may provide links to other websites and online resources and services. We are not responsible for such external websites and/or resources and your use of these websites and/or resources is at your own risk.

We may provide tools to allow you to link to the Arthur’s Place website directly from a third party website (for instance you may like us on Facebook or other social media websites). If you do link to the Arthur’s Place website (whether using such tools or otherwise), you agree that you will disable and remove any such link promptly upon our request.

LIABILITIES AND GOVERNING LAW

Your use of the Arthur’s Place website and reliance on any Content is entirely at your own risk. We (including partners engaged by us to provide the Arthur’s Place website or any Content) will not be liable for any amount or kind of loss or damage that may result to you or a third party arising from your use or inability to use the Arthur’s Place website (including any links to this website), reliance on any Content found on or through the Arthur’s Place website or due to failures of telecommunications, the Internet, electronic communications, corruption or loss of data or property by any means or viruses or spyware that may infect your computer equipment on account of your access to, use of, or browsing the Arthur’s Place website or your downloading of any Content. These Terms & Conditions set out our entire liability with respect to access to the Arthur’s Place website (including the Contents).

Nothing in these Terms & Conditions shall exclude or limit liability for: (A) death or personal injury caused by our negligence or the negligence of our officers, employees, contractors or agents; (B) fraud or fraudulent misrepresentation; or (C) any other liability which cannot be lawfully excluded by these Terms and Conditions.

These Terms & Conditions shall be governed by the laws of England and any dispute arising from these Terms & Conditions or your use of the Arthur’s Place website shall be subject to the jurisdiction of the English Courts.
